When a request is made under the Access to Information Act, Immigration, Refugees and Citizenship Canada (IRCC) is obliged to respond within 30 days. However, an extension for a reasonable period may be granted if certain criteria is met such as:
- the request involves a large number of records or requires a search through numerous records,
- and meeting the original time limit would disrupt the operations of the government institution.
In addition, if consultations are required to comply with the request and cannot be completed within the original time limit, a time extension may be granted. If the extension period required exceeds 30 days, the head of the institution is required by law to inform the Information Commissioner of the extension under subsection 9(2) of the Act.
